2. Nature of Research Services

All research products and deliverables produced by The Mispillion Group - including but not limited to district intelligence reports, policy briefs, economic analyses, and AI governance assessments - are derived from publicly available records, government datasets, academic sources, and proprietary analytical frameworks.

Our work product reflects conditions and data available as of the date of delivery. We make no representations or warranties, express or implied, as to the completeness, accuracy, timeliness, or fitness for a particular purpose of any deliverable. Political, legislative, economic, and policy environments change; clients are responsible for applying independent judgment to any research output.

Proprietary indices developed by The Mispillion Group - including the State Legislative Vulnerability Index (SLVI), the State Constitutional Office Voting Index (SCOVI), and the Insulation-Instability Index (III) - represent analytical constructs derived from historical public data. They are not predictive guarantees of electoral or policy outcomes.

3. Permitted Use of Deliverables

Research deliverables are licensed for the client's internal use only. Unless a separate written agreement expressly permits broader use, clients may not:

4. No Warranty; Limitation of Liability

All services and deliverables are provided on an "as is" and "as available" basis. The Mispillion Group expressly disclaims all warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by applicable law, The Mispillion Group's total liability to any client for any claim arising out of or relating to services rendered shall not exceed the total fees paid by that client for the specific engagement giving rise to the claim.

The Mispillion Group shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits or lost opportunities, arising out of or related to any research deliverable, recommendation, or advisory service.

5. Non-Exclusivity and Confidentiality

The Mispillion Group operates as a non-exclusive public-record research vendor. The firm may sell the same or substantially similar research products - including district intelligence reports - to any party in any race or policy matter, including opposing candidates, committees, or organizations. Purchase of any product or service does not create exclusivity of any kind.

The firm maintains a strict information barrier across engagements: client identity, inquiry details, and project scope are not shared across clients. All purchasers receive research derived from the same public data sources and proprietary analytical frameworks; no client receives preferential data or analysis.

By submitting an inquiry or purchasing a product, the client acknowledges and accepts this non-exclusivity policy.

6. Inquiry and Intake Forms

Submission of an inquiry or intake form on this website does not constitute a binding engagement or contractual commitment by either party. Engagements are formalized only upon written confirmation of scope and, where applicable, receipt of a retainer or payment.

Information submitted through site forms is used solely to evaluate and respond to the inquiry. We do not sell or share contact information with third parties for marketing purposes.

7. Intellectual Property

All content on this website - including text, analytical frameworks, index methodologies, report structures, and branding - is the property of The Mispillion Group LLC and is protected by applicable copyright, trademark, and trade secret law.

8. Governing Law and Dispute Resolution

These Terms of Use and any engagement with The Mispillion Group are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Any dispute arising out of these terms or a client engagement that cannot be resolved informally shall be submitted to binding arbitration under the rules of the American Arbitration Association, with proceedings conducted in Kent County, Delaware. Each party bears its own attorney's fees unless an arbitrator finds a claim to be frivolous, in which case fees may be awarded against the filing party.

9. Modifications

The Mispillion Group reserves the right to update these Terms of Use at any time. Material changes will be reflected in a revised effective date. Continued use of this website or submission of inquiries following any revision constitutes acceptance of the updated terms.
